Although the delivery of healthcare has changed over time, the
legal aspects of clinical practice continue to be expressed through
fundamental principles. The law translates societal expectations
for a healthcare provider's conduct by establishing a process to determine
whether a healthcare provider's conduct has been reasonable under the circumstances.
Even though the circumstances of healthcare providers may vary, the legal
implications of clinical practice are drawn from the basic legal
principles explored in this course.
The case studies in this course that examine the professional
conduct of healthcare providers are actual court cases. The course is problem-based
focusing on the clinicolegal situations that arise in the course
of the provider-patient encounter. By reviewing and analyzing medicolegal
cases, healthcare providers will become aware that certain events may indicate
substandard care.
Clinicolegal situations are those sets of facts and circumstances
that connect professional conduct to legal consequences. Clinicolegal
analysis is directed at fundamental legal questions: What legal
interests are involved in a particular case? Who has duties to whom?
How is the performance of those duties measured? What basic factors
alter the scope of duty, standard of performance, or legal consequences
for professional conduct?
