The ELM Risk & Safety Institute is a self-study educational vehicle designed to alert healthcare professionals to legal issues that could affect their clinical practice. It was designed, developed and tested by ELM Exchange, Inc. ELM is responsible for the technical aspects of this program. ELM Risk & Safety Institute provides:
- Fundamental Medical-Legal Education: Using a case-based approach, ELM courses illustrate the complex interactions between medicine and law. The case studies are redacted from actual medical malpractice cases, either appellate decisions or those the ELM physician-attorneys worked on personally.
- Educational and Technical Support: Our knowledgeable customer service representatives are available to assist you throughout your learning experience. Please visit the Help section at any time, if you need assistance.
Legal Disclaimer: The ELM Risk & Safety Institute is not a source of legal advice for actual legal problems. The authors, producers, and sponsors are not offering legal advice. The opinions expressed in this course belong to the authors, and are not offered as the opinions or recommendations of the producers or sponsors. Although the case studies used in this course are based on actual medical malpractice cases, the facts have been adapted to illustrate various medical-legal issues. Legal principles have been adduced from common law decisions, not from statutory or regulatory laws.
Although information contained in this course is thought to generally reflect a nationwide approach to this field, the law of any one state may differ from that of the majority of states. Therefore, the principles expressed should not be used as a substitute for seeking legal advice from an attorney who is familiar with the laws of a specific locality. Legal considerations involved in medical malpractice claim adjudications arise in specific factual contexts that require case-specific analysis, interpretations and the applications of often times unclear or changing principles. Because of variations in fact patterns and local jurisdictions, specific consultation should be obtained before formal action is taken based on any information contained in this course. Information in this self-study program is not intended to be, and should not be used as a substitute for legal advice or contextually based claim adjudication. For specific guidelines on any actual or potential malpractice claim, or for an opinion on a specific liability exposure, consult an attorney.

Program Overview
Although the delivery of health care has changed over time, the legal aspects of clinical practice continue to be expressed through fundamental principles. The law translates societal expectations for a healthcare professional's conduct by establishing a process to determine whether a conduct has been reasonable under the circumstances. Even though the circumstances may vary, the legal implications of practice are drawn from the basic legal principles explored in this course. The case studies used in this course are actual court cases.
Program Objectives
Completion of ELM courses allow learners to:
- Become aware of societal expectation for professional conduct
- Understand when exposure to liability is present in practice
- Recognize and prevent the factors that may cause a risk to materialize
- Respond appropriately to those clinical situations
- Evaluate the clinicolegal options available and compare their consequences
